Ownership of Website Content:

All content on the  www.elix-polymers.com website, but not limited to, its programming, design, edition, compilation, texts, graphics, icons, buttons, documents, databases, sound and/or image files, illustrations, videos, audiovisual material, source code, logos, brands, trade names and other distinctive signs or elements that may be subject to industrial and commercial use (hereinafter, interchangeably, the ”Website Content” or the “Content”), is protected by intellectual and industrial property rights held by ELIX Polymers S.L.U. or for which it holds the licence or has the express authorisation of their legitimate owners.

Scope of the Limited Licence:

Merely viewing, printing, downloading or temporarily storing, either in whole or in part, the contents and/or elements uploaded by ELIX Polymers to the Website is authorised solely for personal, private and non-profit use by the User, provided that, in all cases, the origin and/or author thereof is indicated and that, where appropriate, the copyright symbol and/or industrial property notes of the owners appear.

The provisions of the preceding paragraph apply provided that:

• Copyright notices, trademark notices and other indications of rights are kept intact.
• The Content or its identifying elements are not altered, modified, decompiled, adapted or manipulated.
• Illustrations, photographs and any other graphic elements are always accompanied by the associated texts.
• No viruses, malware or other elements that may damage the systems of ELIX Polymers, its suppliers or third-party users are introduced.

Using any other rights in any other way shall be subject to the prior and express authorisation specifically granted for that purpose by ELIX Polymers or the third-party owner of the rights affected.

Specific Prohibitions:

Except with the prior express written consent of ELIX Polymers or the lawful owners, the User, the Customers and/or the Authorised User undertake not to :

• Publish, license, sell, assign, lease, rent, transfer, publicly disclose, reproduce, copy, re-use, distribute or exploit the Website Content in any way (in whole or in part, in any medium, for commercial or non-commercial purposes).
• Modify, alter, decompile and/or any exploit the Content, the image rights of which ELIX Polymers has the right to exploit, in any way.
• Extract or re-use all or a substantial part of the databases or Content, or upload data obtained from such databases to other physical or digital repositories, even for non-commercial purposes.
• Republish the Content or incorporate it into their own or other databases.
• Remove or alter copyright notices, metadata, watermarks or technological protection measures.
• Use the Content to send unsolicited advertising or to carry out activities that are unlawful or contrary to good faith.

Trademarks:

All product names in capital letters or other prominent formats on this website are trademarks of ELIX Polymers. Unauthorised or improper use of these trademarks or other materials is expressly prohibited and may constitute an infringement of copyrights, trademarks or other intellectual or industrial property rights.

Restrictions on images, videos and logos:

All images, videos, illustrations and other graphic and/or audiovisual content on the website are the exclusive property of ELIX Polymers and are protected by intellectual and industrial property rights.

The User is strictly prohibited from reproducing, distributing, publicly disclosing, transforming, copying, modifying or otherwise using such Content in publications, social media, commercial, promotional, advertising or training materials without prior written permission from ELIX Polymers.

The use of the ELIX Polymers logo by third parties for advertising or promotional purposes requires prior written approval.

Liability and Indemnity:

The User undertakes to use the Website in accordance with the applicable regulations and with this clause. They will be liable for any misuse of the Website or its Content and shall hold ELIX Polymers harmless from any claims, damages, penalties or liabilities arising from such use.

Any unauthorised use will constitute a material breach and will entitle ELIX Polymers to: (i) suspend or deny access to the Website without prior notice; and (ii) bring the appropriate civil or criminal actions. Infringements may result in damages and criminal liability under applicable law.

Without prejudice to the foregoing, if the User believes that any content of the Website may infringe intellectual and industrial property rights, we ask them to please inform us as soon as possible by emailing [email protected], subject line: “Website Content.”
